1. Definitions
In these Terms and Conditions:
‘services’ includes seminars, courses and events.
‘goods’ includes books, ebooks and products.
‘YBHTA’, ‘we’ or ‘us’ means Your Body Has The Answer Pty Ltd.
2. General
2.1 These Terms and Conditions apply to any purchase of goods or services from YBHTA.
2.2 These Terms and Conditions may be amended periodically and you will be deemed to have accepted any amendments if you use the website after those amendments have been posted.
3. Contract and price
3.1 All prices are in Australian Dollars and inclusive of GST, unless otherwise indicated or the product/service is exempt.
3.2 Description of goods, services and prices may be subject to change or correction at any time without notice. Although we seek to ensure information is correct, we make no representation or warranty as to information being accurate or complete. If we discover an error, we will try to notify you as soon as possible and allow you to cancel your order and obtain a refund if desired.
3.3 By submitting an order you warrant that:
you are authorised and able to make payment via the method you have chosen,
the information you have provided is correct
3.4 A contract for purchase is only formed once we have accepted an order by issuing a receipt number.
4. Delivery
4.1 Delivery will usually take place 7 to 10 working days after acceptance of an order, International Orders can take up to 30 days especially at busy periods e.g Christmas. However sometimes goods or services can be temporarily or permanently unavailable. YBHTA is not liable for any loss arising from delays in delivery or failure to deliver (although you may request a refund if you do not receive goods properly ordered: see section 6 below).
4.2 For some products we may be unable to ship outside Australia or we may request additional delivery fees.
5. Refund/cancellation policy
5.1 Should you receive incorrect, damaged or faulty goods, please contact YBHTA within 7 days of receipt and we will arrange, as appropriate and depending on availability, a goods exchange, credit or refund. We will be pleased to consider exchange, credit or refund for other reasons, but the decision whether to grant this will be at our discretion. Any refund will be made using your original payment method or another method at our discretion.
5.2 Should you be unable to attend a workshop/seminar you have paid for, you may transfer on to the next available workshop if 10 working days cancellation notice is received. If the next course date is more than 12months away then you may receive a refund at the discretion of YBHTA.
5.3 Students cannot receive a refund on any homestudy unit once it has been received. Including the Kinesiology Foundation Training Pack. All course notes are non-transferable to another student.
5.4 Once training has commenced for a supervised course, no refund is available to students who leave before the completion of the course. Students who have enrolled for a supervised course and who pay by monthly instalments will be liable for the full course fee should they chose to leave.
N:B Students who have certified medical reasons or personal hardship may apply for special consideration. If application is accepted, a refunded portion of the course fee may be considered in relation to those components of training that have not been started by the student, minus $200 enrolment fee.
5.5 Should YBHTA cancel a course for any reason you are entitled to a full refund of fees.
5.6 Private treatment bookings require a $60 deposit. You may transfer this deposit to a new suitable date/time should you need to change your appointment, if 24 hours cancellation notice is given.
5.7 To claim a refund, exchange, credit, or for further information please contact YBHTA via our website.
6. Warranties and liabilities
6.1 YBHTA excludes any condition or warranty, unless it is expressly set out in these Terms and Conditions or is by law incapable of exclusion, restriction or modification.
6.2 YBHTA will under no circumstances be liable for any indirect, incidental or consequential loss or damage arising in relation to any transaction entered into, or any goods or services purchased, through this website.
7. Security Policy
7.1 When purchasing from YBHTA your financial details are processed by our payment gateway service provider, eWay. Payment and personal details are sent to eWay using GlobalSign SSL technology. No credit card details are stored on our servers. If you have any questions regarding our security policy, please contact us via our website.
8. Privacy
8.1 YBHTA respects your privacy and the confidentiality and security of personal information provided by you to us. How we handle your personal information is explained in our Privacy policy.
9. Disclaimer
This website does not intend to diagnose.
The information shared is not a replacement for a consultation with a duly licensed health care professional and is always intended to be subsidiary to such a consultation.
Do not diagnose yourself. If you have any symptoms that suggest an illness, go and see a trained doctor who can make a skilled diagnosis.
If you are taking any medication, have a condition under medical supervision, or if you are pregnant or breast feeding, please consult your doctor before taking any supplements or making dietary changes.
10. Student Contract
10.1 All face-to-face client orientated work must be supervised by the tutor. Such supervision may not necessarily involve the actual presence of your tutor but your tutor must monitor, guide and approve any interventions, advice or hands on treatment before it is applied to the client.
10.2 All students are expected to have read the code of ethics as outlined in the Foundation Kinesiology Interactive homestudy training pack and agree to abide by them.
10.3 Students must maintain confidentiality between other students at all times.
10.4 If a student decides to discontinue his studies for any reason then the course fees are still payable in full. All course fees must be paid for before taking the final examinations.
10.5 The Kinesiology syllabus is exclusive to trained Instructors and as such all material given on the course is confidential and is not to be copied or shared unless proper Instructor training is completed. Course notes are non-transferable.
10.6 Students are required to wear sensible clothing and pants/shorts to class (no skirts/dresses).
10.7 Students must declare any infectious diseases that may cause risk to fellow students, tutors or clients.
10.8 Students must agree to hand in homework at the time, unless prior arrangement with the tutor has been made. Homework must be typed or clearly legible.
10.9 Students must hand in 20 case studies during the Foundation stage and 70 case studies during the Diploma stage.
10.10 Students must achieve a minimum of 90% attendance to qualify for entry to the examination. We ask students not to book holidays during course hours. An additional fee of $100 per hour private tutoring is available if a class is missed.
10.11 Students must notify their tutor of any special circumstances such as dyslexia, physical handicap or English as a second language, prior to the commencement of the course.
10.12 On successful completion of the Diploma course students must adhere to the rules of the governing organization relating to Continuing Professional Education and professional conduct.
10.13 Complaints about the course, tutor or fellow students must follow the correct
procedure outlined by Aminya Natural Therapies Academy and the International Institute of Complementary Therapists.
10.14 Your Body Has The Answer reserves the absolute right to refuse admission onto a course or to request that a student discontinues a course where this is deemed necessary. If a student is asked to leave a course, after careful consideration by the academy, then course fees are payable up to the amount of training that has been received.
10.15 Although not an entry requirement of the course, students accept they are aware that police checks may be completed by the industry body, before insurance to work as a Kinesiologist is given.
10.16 Phones can be disruptive to the classroom environment, as well as a possible risk to health, and as such please respect the following guidelines:
Mobile phones must be kept switched off and in the student’s bag at all times.
Mobile phones may only be used at lunchtime or during breaks.
Users must display courtesy, consideration and respect for others when using a mobile phone in the college.
Mobile phone cameras (still and video) and audio recorders must not be used to film or audio record people and their activities without their knowledge or permission anywhere in the college, including the classroom.
In the event of a student’s personal emergency, students may check their phone discreetly in their bag after alerting the tutor that they may need to check their phone during that lesson.
